Welcome to the Asia Pulp & Paper Securities Class Action Settlement Home Page.

If you purchased or otherwise acquired any of the publicly-traded securities of the Asia Pulp & Paper Company Ltd. and its subsidiaries during the period between August 28, 1998 and April 4, 2001, inclusive, then you could get a payment from a class action settlement.

Excluded from the Settlement Class are:

  1. Asia Pulp & Paper, its subsidiaries and affiliates, and its officers and directors and members of their immediate families, the Defendants, members of the immediate families of each of the Defendants, any entities in which the Defendants have a controlling interest, and the legal representatives, heirs, successors, predecessors in interest, affiliates or assigns of any of the Defendants;

  2. any putative Class Members who exclude themselves by filing a request for exclusion in accordance with the requirements set forth in the Notice of Pendency of Class Action and Proposed Settlement; and

  3. any purchaser of any Asia Pulp & Paper Instrument who pursuant to the restructuring of Asia Pulp & Paper’s principal Indonesian operating subsidiaries is entitled to and has tendered the relevant Asia Pulp & Paper Instrument into the relevant restructuring and is entitled to receive Restructuring Consideration in respect thereof, in accordance with terms of the restructuring, but such person(s) is (are) excluded only with respect to each relevant Asia Pulp & Paper Instrument that was tendered and for which Restructuring Consideration is available with terms of the restructuring and is not excluded with respect to any other Asia Pulp & Paper Instrument purchased during the Class Period. Also excluded from the Class are persons and/or entities who exclude themselves from the Class in accordance with requirements set forth in the Notice of Pendency of Class Action and Proposed Settlement dated November 30, 2005.

The Settlement sets forth a recovery of US $46 million which, if approved by the Court, will be distributed among Class Members who submit valid Proof of Claim and Release forms.

The Settlement resolves the Consolidated Action which alleges that in the Spring of 2001, Asia Pulp & Paper began to disclose adverse information that was materially different from prior representations as to its assets and income, resulting a dramatic fall of market prices of its securities.
